Public /Products Liability

Public & Products Liability Insurance will protect the Insured against claims arising from Personal Injury and/or Property Damage occurring in connection with the Business as a Market Stall Holder.

Limit of Indemnity

Choice of AUD $10,000,000 and AUD $20,000,000 Public and Products Liability.

The LIMIT OF INDEMNITY in respect of any one occurrence or series of occurrences arising out of or attributable to any one cause or event shall not exceed the Limit of Indemnity in the Schedule.

The LIMIT OF INDEMNITY is to be applied as an aggregate limit in respect of all CLAIMS arising from one or the same source or originating cause.

Territorial Limits

Commonwealth of Australia

Governing Law and Jurisdiction

The law of Australia shall govern this Policy and the parties agree to the exclusive jurisdiction of competent courts in the Commonwealth of Australia with respect of any dispute or difference arising.

Excess

NIL each and every claim costs exclusive.

Conditions

As per Section 8 of the policy wording.

Exclusions
  1. Bodily Injury to any employees/staff/volunteers
  2. Recall, Repair or Replacement of Products
  3. Aviation and Aerospace Products
  4. Exports to USA & Canada
  5. Products not complying with Australian Standards
  6. Food Stalls not complying with food safety certificate/licence
  7. War and Similar Risks
  8. Radioactive Contamination
  9. Contractual Liability
  10. Pollution or Contamination
  11. Advice for a Fee
  12. Total Asbestos Exclusion
  13. Cyber Liability Exclusion
We are not able to offer Products Liability for any of the below Products:
  1. Imported & manufactured toys (new toys sourced from Australian suppliers are acceptable)
  2. Second hand toys
  3. Imported & manufactured electrical products (new electrical products sourced from Australian suppliers are acceptable)
  4. Second hand electrical goods
  5. Second hand mechanical goods
  6. Bicycles
  7. Uncooked Seafood
  8. Animal feed intended for animals other than domestic pets
  9. Medicines, potions, oils, fragrances, beauty products, laundry & cleaning Products
  10. Silicone Jewellery and/or Teething Rings/Beads
  11. Any goods that could be described as hazardous, flammable or dangerous which includes but is not limited to:
    • Products that have been dispensed, or have been repackaged into smaller containers for retail sales
    • Products sold in containers exceeding 5 litres or 5kg
    • Explosive tools, fireworks, flammable liquid or bulk pool chemicals
    • Products intended to be used in connection with the navigation, safety or controls of vehicles, aircraft or watercraft
    • Parts for motor vehicles
    • Amusement Rides, Animal Rides or Similar Activities
    • Medical equipment
    • Guns &/or ammunition
    • Model aircraft, drones
    • Knives, swords or spears
    • Power tools
    • Motorised vehicles
    • Self-balancing motorised boards and scooters
    • Deep frying activities
    • Alcohol
    • Any chemical related products
